1. Acceptance of Terms
These Terms of Service ("Terms") form a binding agreement between you and Cartivo ("we", "us", "our", or the "Service"). By accessing or using the Service — including by connecting a Facebook Page to it — you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.
2. Description of the Service
Cartivo is an order-management platform for social commerce. It connects to Facebook Pages through Meta's official APIs, reads customer comments made under the Page's posts, recognizes product codes in those comments, and automatically converts them into orders with inventory tracking for the Page owner to fulfil.
The Service is a tool for sellers. We are not a party to any sale between a Page owner and their customers, and we do not process payments.
3. Eligibility & Accounts
- You must be at least 18 years old and legally capable of entering into contracts to operate a seller account;
- You must be an authorized administrator of any Facebook Page you connect to the Service;
- You are responsible for keeping your account credentials confidential and for all activity under your account;
- You must provide accurate information and keep it up to date.
4. Facebook Integration
The Service integrates with Facebook via the Meta Graph API, Webhooks and Facebook Login. By using this integration you agree that:
- Your use of Facebook remains subject to Meta's own Terms of Service and policies;
- You grant the Service permission to access your connected Page's posts and comments solely to provide the functionality described in Section 2;
- You may revoke the Service's access at any time via your Facebook settings or by disconnecting the Page in the dashboard;
- The Service is an independent product. It is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. "Facebook" and "Meta" are trademarks of Meta Platforms, Inc.;
- Availability of the integration depends on Meta's APIs; we are not liable for changes, limits or outages imposed by Meta.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of Meta's platform policies;
- Connect Pages you are not authorized to manage;
- Use the Service to spam, harass, mislead or deceive customers;
- Attempt to gain unauthorized access to the Service, its data, or other users' accounts;
- Reverse engineer, resell or sublicense the Service without our written consent;
- Interfere with the operation or security of the Service, or introduce malicious code;
- Scrape, harvest or misuse personal data of customers beyond what is needed to fulfil their orders.
6. Orders & Transactions
- Orders created by the Service reflect customer comments as detected by automated matching. The Page owner is responsible for verifying orders before fulfilment;
- All sales contracts are concluded directly between the Page owner and the customer. The Page owner is solely responsible for product quality, pricing, delivery, taxes, refunds and consumer-law compliance;
- We do not guarantee that every comment will be detected or matched correctly.
7. Intellectual Property
The Service, including its software, design and documentation, is owned by us or our licensors and is protected by applicable intellectual property laws. You retain all rights to the content you enter into the Service (product data, images, order records). You grant us a limited license to host and process that content solely to operate the Service.
8. Privacy
Our collection and use of personal data is described in the Privacy Policy, which is incorporated into these Terms by reference. Page owners act as independent controllers of their customers' data and must comply with applicable data-protection laws (including the GDPR where relevant).
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT COMMENT DETECTION WILL BE ACCURATE OR COMPLETE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY (50) EUROS IF NO PAYMENT WAS MADE. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Termination
- You may stop using the Service and disconnect your Facebook Page at any time;
- We may suspend or terminate access immediately if you breach these Terms, violate Meta's policies, or create legal or security risk;
- Upon termination, your Page access tokens are invalidated and data is handled as described in the Privacy Policy;
- Sections 7, 9, 10 and 13 survive termination.
12. Changes to These Terms
We may modify these Terms from time to time. The "Last updated" date above reflects the latest revision. If changes are material, we will provide reasonable notice through the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Lithuania, without regard to conflict-of-law principles. Any disputes shall be resolved by the competent courts of Lithuania, unless mandatory consumer-protection law provides otherwise.
